Terms of Service

These Terms of Service ("Terms") govern your access to and use of the SpectralFlo platform, website, and API (collectively, the "Service") operated by KISCA, LLC ("KISCA," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, accessing the website, or using the API, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Description of Service

SpectralFlo is a blockchain analytics platform that provides real-time MEV (Maximal Extractable Value) intelligence, including event detection, classification, threat scoring, entity resolution, and alerting across multiple blockchain networks. The Service is provided via a web dashboard, API, and WebSocket feeds.

3. Eligibility

You must be at least 18 years of age and capable of forming a binding contract to use the Service. By using SpectralFlo, you represent and warrant that you meet these requirements.

4. Account Registration

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete registration information
• Maintain and promptly update your account information
• Maintain the security of your password and API keys
• Accept responsibility for all activity under your account
• Notify us immediately of any unauthorized use of your account

5. Subscription Plans and Payment

SpectralFlo offers tiered subscription plans. By subscribing to a paid plan, you agree to pay the applicable fees. All fees are non-refundable except as required by law. We may change pricing with 30 days' advance notice. Payment is processed securely through Stripe.

6. API Usage

Access to the SpectralFlo API is subject to rate limits based on your subscription tier. You agree not to:

• Exceed the rate limits of your plan
• Attempt to circumvent rate limiting or access controls
• Use the API to build a competing product or service
• Redistribute raw API data without written permission
• Use automated tools to scrape or harvest data beyond your plan's limits

7. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law, regulation, or third-party rights
• Facilitate market manipulation, fraud, or other illegal activity
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to any part of the Service
• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service in any way that could damage, disable, or impair it

8. Intellectual Property

The Service, including all software, algorithms, ML models, data processing pipelines, dashboards, documentation, and branding, is owned by KISCA, LLC and protected by intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service during your subscription period.

9. Data and Analytics

SpectralFlo provides blockchain analytics derived from publicly available on-chain data. We make reasonable efforts to ensure accuracy but do not guarantee that all data, classifications, or threat scores are error-free. The Service is provided for informational and analytical purposes. It is not financial, legal, or investment advice.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KISCA, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID BY YOU IN THE TWELVE MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless KISCA, LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising out of your use of the Service or violation of these Terms.

13. Termination

We may suspend or terminate your access to the Service at any time for any reason, including violation of these Terms. Upon termination, your right to use the Service will immediately cease. Sections that by their nature should survive termination will survive.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page. Your continued use of the Service after changes constitutes acceptance of the revised Terms.

15. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Florida.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and KISCA, LLC regarding your use of SpectralFlo.
